Bay Travel LLC dba Your Private Africa Terms & Conditions

Acceptance Acknowledgement: Payment of Deposit for a booking constitutes your (“you” or “client”) acceptance of these Terms and Conditions (“Terms”), which describe the terms and conditions by which Your Private Africa will agree to provide its services to you.

The payment of the Deposit or any other partial payment for a reservation relating to the Tour constitutes consent by all clients covered by that payment to all provisions of these Terms, whether or not the client has signed the Reservation Booking Form. These Terms, under which you agree to participate in the Tour activities, cannot be changed or amended except in writing signed by an authorized officer of Your Private Africa.

DEFINITIONS. As used in these Terms:

“You” shall be considered and used synonymously with client, customer, guest, participant, member, passenger, and traveler all of which refer to “you.”

“Departure Date” shall refer to the date your Tour is scheduled to begin, or the date on which you actually commence any scheduled travel activities, whichever occurs earlier.

“Property” shall mean physical accommodations: camp, lodge, hotel, guesthouse, tent, or other accommodation.

“Deposit” shall refer to the non-refundable deposit payment of thirty per cent (30%) of the total Tour Price necessary to confirm your booking for the Tour.

“Balance Payment” shall refer to any payment due and payable after payment of the Deposit towards the total cost of the Tour Price, including but not limited to, payment for accommodation at Tour Properties, excursions, airline tickets, Internal Flights and animal viewing permits. This may entail a single payment or multiple payments as necessary to pay costs such as airline tickets as they become due.

“Internal Flight” shall refer to any airline flight taken within the destination country/continent, including without limitation any chartered flight within the area of the Tour destination.

“Operator” shall refer to any third-party vendor or supplier or similar service provider who provides services in the destination countries including operators of Properties and those facilitating safaris, transfers, flights, expeditions and other aspects of the Tour.

“Itinerary” shall refer to the written itinerary for a Tour including all reserved transportation, activities, and accommodations

“Release” means the liability Waiver & Release Agreement between you and Your Private Africa.

“Tour” means any safari, adventure travel, hiking or climbing expedition, or other similar travel or recreation arrangements directly provided to client by Operators, which are planned and booked by Your Private Africa as agent on your behalf and described in the Itinerary.

“Tour Price” shall refer to any and all funds paid in connection with any Tour, including, but not limited to the Deposit Payment, Balance Payment and any other fees.

“Guide” shall refer to any person responsible for leading a Tour on behalf of or in conjunction with Your Private Africa.

“Force Majeure” means an event beyond the control of the client and Operator, including without limitation: (i) Acts of God (including, but not limited to, fires, explosions, earthquakes, drought, tidal waves, and floods, riots, war, civil disturbance, strikes including strikes by Operators); (ii) plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions; or (iii) government acts such as quarantine restrictions, travel bans, denial of entry, or personal history (e.g., court records or travel restrictions).

  1. Payment Terms
    All prices quoted are based on tariffs in effect at the time of written quote except where specifically stated otherwise. Prices are subject to alteration at any time consequent upon any changes in tariff or taxes imposed by our suppliers or changes in the rate of exchange. All charges include Government Tax and shall be subject to alteration if the rate changes prior to the event.Your Private Africa make all reasonable efforts within its control to extend the deadlines of Operators where possible on a case-by-case basis but cannot guarantee any extensions. Non-payment by given deadlines will result in the cancellation of agreed upon services. No monies will be paid by Your Private Africa to prospective Operators without having previously received appropriate funds from you.

    FOR ALL VACATIONS INVOLVING A RENTAL (GROUP OR INDIVIDUAL) TRAVELERS WILL BE ASKED TO PROVIDE A VALID CREDIT CARD. YOUR PRIVATE AFRICA MAY CHARGE AN ADDITIONAL SECURITY DEPOSIT UP TO $5,000 PER TRAVELING PARTY TO BE REFUNDED UPON RETURN. For all tours and packages involving villa or apartment rentals, Your Private Africa will hold the travelers and renters directly and solely responsible for any damages incurred during their stay up to a reasonable point. Your Private Africa will debit the traveler’s card on file and hold funds until the dispute has been resolved. Failure to dispute or comply with damage charges assessed by Your Private Africa may result in legal action, whereby you agree that Your Private Africa shall have the right to collect reasonable costs and necessary disbursements and attorney’s fees incurred in enforcing these Terms.

  2. Payment Schedule.
    1. Payment of the non-refundable Deposit is required upon written confirmation of booking to secure reservations for your Tour.
    2. Balance Payment is due 60 days prior to Departure Date.

    You will be notified if a larger deposit is required should Operators require additional deposits above the specified amount. Funds from Deposits are disbursed to Operators upon receipt and cannot be recovered from Your Private Africa. Deposits are 100% non-refundable, no exceptions. Your Private Africa recommends that you purchase travel protection to cover your Deposit.

  4. Cancellation and Refund Terms.
    All Deposit payments are non-refundable. Any cancellation of your booking must be in writing. Cancellations are only effective upon receipt of such written notice, and subsequent confirmation by a representative of Your Private Africa via email at Nick@yourprivateafrica.com. If your cancellation is made after the due date for full payment the Balance Payment, cancellation charges, expressed as a percentage of the total Tour Price, shall be levied as follows:

    1. More than 60 days’ notice prior to Departure Date: -­ Deposit forfeited
    2. Less than 60 days’ notice prior to Departure Date: -­ 100% forfeited

    Funds from the Balance Payments are disbursed to Operators upon receipt and cannot be recovered from Your Private Africa. Final Balance Payment is non-refundable under any circumstances and travel protection is recommended to cover cancellation covering unforeseen circumstances.

    Note that Properties and certain other Operator services arranged by Your Private Africa may have their own cancellation fees. Such fees are in addition to any cancellation fees imposed by Your Private Africa and may not always be disclosed by the Operator until the time of cancellation. All cancellation fees are the sole responsibility of the client.

    Should you fail to join a Tour safari or other expedition included as part of your Itinerary, or join it after departure, or leave it prior to its completion, no refunds will be provided, and you will forfeit any and all payments made to Your Private Africa, subject to the terms in this Section 4.

    We recommend that you purchase a travel protection plan to help protect you and your travel investment against the unexpected.

    Please note that if the reason for cancellation falls within the coverage terms of any travel protection insurance plan that you hold, then, depending upon the terms of such insurance policy, your insurance company will normally refund you, subject entirely, however, to the particular terms and conditions of your insurance policy. There are certain restrictions, exclusions and limitations that apply to all insurance coverages. Plan benefits, limits and provisions may vary by state/jurisdiction and not all coverage is available in all states/jurisdictions. Your Private Africa assumes no responsibility for obtaining travel protection insurance coverage for you or for the insurance company’s provision of any benefits under such policy.

  5. Booking Procedures.
    On receipt of your Deposit, we will, subject to availability, reserve your place on your Tour. When we send off your confirmation invoice to the various Operators, your booking is confirmed and accepted by us. Balance Payment is due in full no later than 60 days prior to Departure Date, as indicated in Section 2 (Payment Schedule) above.Client is responsible to ensure that all arrangements are booked as requested and that the Itinerary contains no errors. Your Private Africa, its employees, and representatives act as agents only for the client purchaser of the travel packages in making arrangements for transportation, hotels and other services based solely on the information provided by client to Your Private Africa.
  6. If you Change Your Booking.
    After your booking has been confirmed, should you wish to change to an earlier Departure Date, you may do so subject to availability and pricing variances. Subject to Section 4 above (Cancellation and Refund), cancellation fees apply if you wish to postpone your departure without a newly scheduled Departure Date. Any additions to your Itinerary will be subject to these Terms and subject to your payment of an additional 30% deposit to ensure the additional booking item(s) is secured.
  7. Luggage Restrictions.
    For safety reasons and because space is restricted on scheduled air transfers if traveling on Internal Flights, usually used to transfer client to safari Properties is restricted to a maximum of 12 kg (26 lbs.) per person in a soft, no-wheels bag (44 lbs. within Botswana and Namibia) – this includes camera equipment and hand luggage and must be packed in a soft bag. Should clients arrive with excess baggage without prior written notice to Your Private Africa, transfer of their baggage could be delayed, as we may have to fly the baggage into camps at a later stage at an additional cost. However, should the client know in advance that the baggage will exceed the limit, it may be possible to book an extra seat to accommodate those bags on the aircraft, or provide storage, at an additional cost to the client, at the discretion of the Operator for such Internal Flight. For private air charters, weight restrictions will be confirmed at the time of booking.
  8. Currency Fluctuations.
    Your Itinerary may include multiple currencies which vary depending on the countries visited during the Tour. Because Your Private Africa does not build any allowance into the Tour pricing to accommodate for fluctuations as currencies continuously adjust, it may be necessary for us to raise the Tour Price at any time before final Balance Payment. An increase in your Tour Price due to currency fluctuations at time of payment is not sufficient grounds for any refund of any fees already paid, and such fluctuations do not constitute just cause to cancel all or any part of the Itinerary for the Tour.
  9. Relationship of the Parties; Our Responsibility.
    Your Private Africa shall be deemed to be an independent contractor for all purposes under these Terms. Your Private Africa is acting solely to facilitate the reservation and purchase of the Tour and is not acting in any other capacity with either the client or the Operators, including, but not limited to, any partnership, joint venture, co-ownership, or agency relationship of any kind with any Operator or client. All bookings are accepted on the specific conditions that Your Private Africa and/or other subsidiaries, affiliated companies, agents act only as booking agents for the owners, outfitters, Operators, contractors, providing means of transportation, accommodation, sightseeing and tours whether by aircraft, railroad, motor coach, ship, boat, or any other means. All tickets, exchange orders or vouchers issued by those described above are expressly subject to any and all terms and conditions under which such means of transportation, accommodation or any other services are offered or provided. Your Private Africa does not have any control over the quality, timing, safety, or legality of any Tour services reserved or purchased by or for a client. Your Private Africa does not and cannot control whether an Operator represents its products accurately or fulfills any agreement or obligation with any client.Your Private Africa and/or their representatives reserve the right to withdraw such a tour or any part of it; to make such alterations in the Itinerary only with the prior consent of the client as is deemed necessary or desirable; to refuse to accept or retain as a member of the Tour any person at any time; and to pass on to Tour members any expenditure occasioned by delays or events beyond the reasonable control of Your Private Africa. In case of any appreciable variation in costs, the right is reserved to make such adjustments to rates as necessary.
  10. Wild Animals.
    Please be aware that our safaris may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. Neither Your Private Africa, nor its owners, managers/officers, employees, or agents can be held responsible or liable for any injury or incident on the Tour. Please note that all safari camps on Properties for our arranged Tours are not fenced, and animals may move freely in and around the camps. Please follow all camp staff safety instructions carefully.
  11. Passport & Visas.
    It is your sole responsibility to ensure that passports and visas are valid for the countries visited. Your Private Africa and its owners, managers/officers, employees and agents cannot be held liable for any visas or other required travel documents not held by the clients, nor for the cost of applying for any visas. Furthermore, Your Private Africa is not responsible for lost or stolen documents, and reissuance of documents may be assessed at their full-face value with a possible of increase in cost.
  12. Certain Expenses Not Included.
    Only Tour items expressly listed in the Itinerary are included in the Tour Price. For avoidance of doubt, you acknowledge that the following additional expenses that may be related to the Tour are not included in the Tour Price: insurance to cover for cancellation and curtailment, medical, baggage and money, emergency evacuation back home; beverages in certain areas; personal laundry at certain camps; gratuities to guides, paddlers and to staff; any excursion not related to the safari; optional meals in Cape Town, Victoria Falls and the bigger towns and cities; scheduled inbound airfares to Africa; and transfers and departure taxes.
  13. Health and Medical.
    Travel to countries within Africa has specific health and vaccination requirements. It is your sole responsibility to discuss your medical requirements with your physician or relevant health care provider. Please consult the World Health Organization website (http://www.who.int) for updated travel health requirements. Participating on Safari or touring in East and Southern Africa requires that you be generally in good health. It is essential that persons with any medical condition and or related dietary or allergic restrictions make them known to Your Private Africa in writing prior to departure and indicate such restrictions and requirements on their Reservation Booking Form.Please note that anti-malaria precautions should be taken, and it is the client’s sole responsibility to consult their own healthcare provider regarding their options and any other vaccinations that may be recommended. If you are a contagious-disease carrier, you must let us know when booking your safari, or you may be refused service at our sole discretion.
  14. Photography.
    Your Private Africa reserves the right to make use of any photograph or film taken on the Tour by our photographers. You hereby agree and provide your consent that any photographs submitted to Your Private Africa can be used for social media or marketing purposes unless otherwise specified by you in writing.
  15. Guide Replacement.
    If a requested Guide is unable to lead any portion of your Tour due to illness, leave of absence, or any other reason, Your Private Africa and its Operators reserve the right to substitute with a different Guide at their sole discretion.
  16. Changes to Schedules.
    Although every effort is made to adhere to Itinerary schedules it should be kept in mind that Your Private Africa and our safari Operators reserve the right (and in fact may be obliged to) occasionally change routes and camps on Tour safaris as dictated by changing conditions. Such conditions may be brought about, among other things, by seasonal rainfall on bush tracks, airfields and in game areas, by game migrations from one region to another, or airline or other booking problems. Your Private Africa shall not be held responsible for such Itinerary changes and shall not be held liable for any refund, provided such changes are beyond the reasonable control of Your Private Africa.As indicated in Section 4 above, all Deposits are non-refundable. Whilst Your Private Africa strives to ensure that all anticipated accommodations and travel activities are available as planned, there shall be no claim of any nature whatsoever against Your Private Africa for a refund either in the whole or part, if any accommodation or excursion is unavailable and a reasonable alternative is not found. Additionally, if the client is unable to use any service listed in the Itinerary, no refund will be due. In the event of cancellation, refunds, if any, shall be subject to Section 4 (Cancellation and Refund).
  17. Insurance Coverage.
    As a condition of Tour booking, it is the sole responsibility of the client to ensure that they carry the correct comprehensive travel and medical insurance to cover themselves, as well as any dependents/travelling companions for the duration of their Tour. This insurance should include cover in respect of the following eventualities, without limitation: cancellation or curtailment of the Tour or any Tour activities such as a safari or other expedition, emergency evacuation expenses, medical expenses, repatriation expenses, and damage/theft/loss of personal baggage, money and goods. Your Private Africa and its owners, managers/officers, employees and agents assume no responsibility, and shall not be held liable for, any damages, costs, or losses incurred or suffered by the client, or client’s travelling companions, with respect to any such eventualities. Clients will be charged directly by relevant service providers for any emergency services they may require during the Tour and may find themselves in a position where they are unable to access needed emergency or medical treatment services should they not be carrying adequate insurance coverage.
  18. Airlines and Delays.
    The air carriers involved in the Tour shall not be held liable for any act, omission or event during the time travelers are not on board their planes or means of conveyance. The passenger’s tickets in use by the air carrier or by other carriers concerned when issued shall constitute the sole contract between the air carrier and the purchaser of such tickets. Please note that we subcontract flying services to independent air charter Operators, and they are responsible as the air carrier for the flying. Airfares are subject to change without prior notice. Note that Internal Flight airfares, whether included in your total Tour Price, may be due and payable in full to Your Private Africa any time after your initial Deposit in order for us to secure ticketing for such flights, as required by the airline or any Operator. Your Private Africa is not responsible, and shall not be held liable, for any airline schedule or fare changes, cancellation, overbooking, damage or loss of baggage and property. Any and all claims for any damage, loss, or injury suffered on any air travel must be made directly with the airline involved and not to Your Private Africa. Air travel schedule changes may necessitate additional nights being added to your Tour. Provided these schedule changes are beyond the reasonable control of Your Private Africa, any resulting additional costs must be borne directly by you. Your Private Africa cannot be held liable for any delays or additional costs incurred as a result of airlines not running on schedule.
  19. Pricing Changes.
    Although we will strive to adhere to the quoted Tour Price, should increases be forced on us by third parties or external conditions (airlines, exchange rate changes, etc.), we reserve the right to surcharge accordingly.
  20. Mobility Requirements.
    Requests for special accommodations and services to meet specific physical requirements must be made at the time of booking by specifying the limits of mobility and the description of mobility assistance equipment used. Such special accommodations are subject to availability at the Property and cannot be guaranteed.
  21. Children.
    Please note that some travel products do not allow children below a certain age. If you plan to travel with children, you must notify Your Private Africa when booking and provide a clear copy of the passport photo page for each traveling child so that we can verify ages.
  22. Safety; Refusal of Service.
    Your Private Africa and our Operators, in their sole discretion, each reserves their rights to refuse to provide you with their services to or to remove you from participation in any Tour activity, for the protection and safety of other travelers/participants, including without limitation for any of the following reasons:

    • you refuse to obey any federal or state regulations, security directives, or instructions given by the Guide;
    • your conduct is or has been known to be disorderly, abusive, offensive, threatening, violent, belligerent, and/or irrational so as to be a hazard or potential hazard to the Guide, other participants/travelers, and/or yourself;
    • your conduct is or has been known to be disorderly, abusive, offensive, threatening, violent, belligerent, and/or irrational toward any owner or employee of Your Private Africa or an Operator;
    • you appear to be intoxicated or under the influence of illegal drugs to a degree that you may endanger the Guide, other participants/travelers, or yourself;
    • you refuse to provide a signed Release or have made a misrepresentation (on the Reservation Booking Form or otherwise), and such misrepresentation renders you unqualified or unfit to participate in the Tour.

    Your Private Africa and our Operators shall not be liable for refusal to transport you or for your removal from participation in accordance with this rule.

  23. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK.
    You acknowledge that you have voluntarily chosen to participate in the Tour designated on the Itinerary (or Itinerary for another Tour you may change to). In so doing, you acknowledge that you may be subjecting yourself to dangers and hazards, which could result in illness, injury, or even death. You also acknowledge that there are inherent risks and dangers, which may arise at any time during the Tour. You are specifically familiar with and accept the risks of the dangers and hazards inherent in partaking in your Tour and are aware that medical services or facilities may not be available while you are participating in the Tour. In order to partake of the enjoyment and excitement of the safari or other adventure travel during your Tour, you are willing to accept the risks and uncertainty involved as being an integral part of the Tour. You agree to assume all risks of illness, injury or death. Furthermore, you acknowledge and agree that a separate signed Release will be required from you prior to your participation in any safari or other adventure travel element of the Tour, including without limitation any Internal Flight, mountain climbing excursion, and other adventure travel activity.
  24. General Disclaimer
    BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, YOUR PRIVATE AFRICA DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH LOCATIONS IS ADVISABLE OR WITHOUT RISK, AND YOUR PRIVATE AFRICA AND ITS OWNERS, MANAGERS/OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT YOUR OWN RISK.Any and all losses and expenses will be borne by you as the traveler, the Tour rates being only for the time period and places specified in the Itinerary. All accommodations, services, and facilities are subject to the laws of the countries in which these accommodations, services, and facilities are provided. Your Private Africa reserves the right to cancel or make Itinerary changes and substitute services without notice and to decline to accept or retain any traveler at any time.

    In all matters relating to the making of arrangements for hotel and/or lodge accommodations, sightseeing tours and services provided incidental thereto, entertainment, and transportation by air, railroad, motor bus, automobile, or steamship, Your Private Africa and its managers and employees act only in the capacity of an agent for the airlines, hotels/lodges, and other Operators stated in the travel literature describing the services purchased. Because of its status as an agent, and because it maintains no control over the personnel, equipment, or operations of these travel Operators, Your Private Africa and its owners, officers, and employees assume no responsibility for, and shall not be held liable for, any personal injury, property damage or other damage, loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason of (1) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the Operators, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any officer or employee of any of these Operators, (3) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these Operators, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise, of Your Private Africa.

    By payment of the Deposit, you accept and agree that Your Private Africa and its owners, managers/ officers, employees, independent contractors, and agents shall not be liable for any injury, damage, loss, accident, delay or irregularity, liability, or expense to person or property due to any act or default of any hotel, carrier, restaurant, company, or person providing or rendering any of the Tour services included in the Itinerary.

    Furthermore, Your Private Africa shall not be held responsible should you dislike the country, places, food and the climate while traveling on the Tour. For all of our escorted travel, our travelers are briefed prior to departure. Should you wish to provide feedback regarding one or many options/activities on the Tour, we will accept comments and remarks and strive to accommodate the traveler in making the vacation as enjoyable as possible.

  25. Limitation of Liability; Force Majeure.
    Your Private Africa and its owners, managers/officers, employees, and agents shall not be liable for any claims, losses, damages, costs, expenses, delays, sickness, injury, or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond the reasonable control of Your Private Africa. In no event will Your Private Africa’s liability exceed the total amounts client paid to Your Private Africa for client’s Tour. Your Private Africa assumes no responsibility for lost tickets, documents, passes, or coupons. Further, Your Private Africa shall not be liable for any injury, loss, claim, damage or any special, punitive, indirect, consequential, incidental damages of any kind, whether based on contract, tort, strict liability or otherwise, which may arise as a result of the use of Your Private Africa’s services or those of its Operators.Acting with the laws governing the travel industry in the state of Washington, in the case of Force Majeure, Your Private Africa shall not be liable for any claims nor be responsible for retrieving funds from the Operator on behalf of the client. Your Private Africa may, in its sole discretion, advocate on behalf of the client for the return of amounts paid and reserves the right to take any action that Your Private Africa deems appropriate under the circumstances.

    In a Force Majeure event, if the Operator is prevented from carrying out its obligations, Your Private Africa will not be held accountable for retrieving funds and is entitled to keep no less than the Deposit.

    Your Private Africa is deemed an independent contractor for all purposes under these Terms. Your Private Africa acts solely for the facilitation and reservation of travel services and is not responsible for any fees or funds held by the Operator. If cancellation of travel falls within the non-refundable dates pursuant to Section 4 above, Your Private Africa may not be held responsible to retrieve those funds.

  26. Governing Law; Disputes; Indemnity.
    These Terms shall be governed by the laws of the State of Washington, without regard to its conflicts of laws principles. Any dispute or claim arising from or relating to these Terms shall be resolved exclusively by binding arbitration before a single arbitrator using the rules of the Judicial Arbitration & Mediation Service (JAMS) sitting in King County, WA. The prevailing party in any such arbitration or legal action shall be entitled to all costs and reasonable attorneys’ fees.Furthermore, as the Tour and related services are performed by Operators for the client (and such Tour services are not provided directly by Your Private Africa), any and all disputes between a client and Operator are solely between that client and that Operator, and the client and Operator should handle all such disputes directly between themselves. If the Operator or client contacts Your Private Africa relating to any dispute between the client or Operator, then Your Private Africa may, in its sole discretion, take actions to facilitate communication and dispute resolution efforts between you and such Operator, and Your Private Africa reserves the right to take any action that Your Private Africa deems appropriate under the circumstances. You agree to release Your Private Africa and its owners, managers/officers, employees, and agents from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes with Operators. Furthermore, Customer agrees to indemnify, defend, and hold harmless Your Private Africa from any liability, loss, claim and expense, including reasonable attorney’s fees, arising out of or in any way connected with such disputes including on any appeal.
  27. Miscellaneous.
    These Terms of Use constitute the entire agreement between you and Your Private Africa with respect to the Tour, and your relationship with Your Private Africa and supersede any and all prior agreements, in any form, between you and Your Private Africa. We may revise these Terms at any time. These Terms shall remain valid until further notice in writing from Your Private Africa. If any section or provision of these Terms is found to be unlawful or unenforceable for any reason, the rest of these Terms will not be affected and will remain valid. You may not sell, transfer, assign, license, or convey in any way your rights or obligations under these Terms.
  28. INDEPENDENT REVIEW.
    You are voluntarily accepting these Terms. By paying the Deposit, you hereby acknowledge that you have carefully read and understand these Terms, you have familiarized yourself with all the information relating to the Tour, including the itinerary for the Tour, and you agree to all terms and conditions set forth in these Terms. You also certify that the Itinerary, which is incorporated by reference and made part of the agreement between you and Your Private Africa according to these Terms, contains accurate information. You understand that these Terms include our disclaimer of liability and your assumption of risk.

 

Bay Travel LLC, dba Your Private Africa is registered with the State of Washington as a seller of travel (UBI # 603-478-162).
